Resolved Question: Montana Minor In Possession Laws. MIP for a 19 year old?

My 19 year old friend lives in Butte, MT and he had a small party at his house last week. The police showed up because people were on the roof and someone had called about a possible break-in. The police showed up and asked him if they could go inside. He said that he was the owner of the house and that they couldn't go inside. So they told him he would have to take a BAC test. He blew a .048 and the police wrote him a ticket for minor in possession. I'm just wondering if they can do this since he isn't a minor and what could be done to get the charges dropped if the officer made a mistake by writing an MIP instead of a UAP. thanks...
